Penguin Management is committed to providing superior client service and this policy outlines our ongoing obligations to our clients in respect of how we manage your personal information.
Penguin Management has adopted the 13 Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The APPs replaced the National Privacy Principles and the Information Privacy Principles on 12th March 2014. The APPs provide guidance as to how Penguin Management collects, uses, discloses, stores, secures and disposes of our clients’ personal information.

Privacy Principle Number 1- Collection of Personal Information and Privacy
Personal Information is information or an opinion that identifies an individual. At Penguin Management the types of personal information that we will need to collect from you, our client includes: your name, email address, mobile number and landline phone number. Depending on the service selected, Penguin Management may also need to collect information regarding your Australian Tax File Number or Australian Business Number to ensure that we are able to provide you with a superior level of service
We collect your Personal Information for the primary purpose of providing our services to you. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure.
When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.
Privacy Principle 2- Anonymity and Pseudonymity
Whilst the APPs enable individuals to not identify themselves, Penguin Management requires our prospective clients and current clients to provide us with identifying information to ensure that we are able to provide suitable services to prospective and current clients.
Privacy Principle 3- Collection of Solicited Personal Information
Penguin Management will need to collect personal information, such as your name and contact details, from you when delivering our services to you. We do not collect sensitive information, which includes information about your race, political opinions, religious beliefs or trade union membership.
Privacy Principle 4- Dealing with Unsolicited Personal Information
If Penguin Management receives information that we did not directly receive from you, we will determine whether such information could have been collected by us and if so, Privacy Principles 5-13 will apply to such information. However, if we determine that we could not have collected personal information from you, we will as soon as practicable, destroy such information but only if it is lawful and reasonable for us to do so.
Privacy Principle 5- Notification of the Collection of Personal Information
When Penguin Management requires personal information from you, our client, we will notify you of the collection of such information.
Privacy Principle 6- Use or Disclosure of Personal Information
If you have provided Penguin Management with personal information, we will not use or disclose your personal information unless you have provided us with consent to do so.
Privacy Principle 7- Direct Marketing
Penguin Management may occasionally use your personal information for direct marketing purposes, such as providing a newsletter regarding updates to our services, or communications regarding other services that you may be interested in based on the services that you currently use from us.
Privacy Principle 8- Cross-border Disclosure of Personal Information
Before Penguin Management discloses personal information about you to a person or business that is overseas, we will ensure that the recipient/s does not breach the APPs.
Privacy Principle 9- Adoption, Use or Disclosure of Government Related Identifiers
Penguin Management will not use or adopt a government related identifier of you, unless we are required to by Australian law. We will also not use or disclose a government related identifier of you, unless it is for the purposes our services to you or we are required under Australian law to do so.
Privacy Principle 10- Quality of Personal Information
Penguin Management will take reasonable steps to ensure the personal information we collect is accurate, up to date and complete. We will also take reasonable steps to ensure the personal information we use or disclose is accurate, up to date, complete and relevant, having regard to the purpose of the use or disclosure.
Privacy Principle 11- Security of Personal Information
The personal information you provide Penguin Management is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure.
When your personal information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your personal information. However, most of the personal information is or will be stored in electronic format for an undisclosed time period.
Privacy Principle 12- Access to Personal Information
Penguin Management will not charge any fee for your access request. In order to protect your personal information we may require identification from you before releasing such information.
Privacy Principle 13- Correction of Personal Information
At Penguin Management we are committed to providing superior services to our clients, and if your information is incorrect we will contact you to ensure our information is correct. However, if you realise your information is incorrect and contact us, via our email address or telephone number, we will update our records to ensure your information is correct.
